Introduction
These Terms and Conditions govern your use of our services, including booking and participating in diving activities. By using our services, you agree to these Terms and Conditions.
Booking, Rates, & Payment
- Payment is made following the completion of your dives. We prefer payment via cash but also accept payment via credit card, direct bank transfer, or online transfer options like Wise. Please note that you will be subject to a 3% surcharge if you use a credit card.
- For direct bank transfers, please note that any additional bank fees are the guest's sole responsibility.
- For groups of 5 or more, a 20% deposit is required at the time of booking.
- All rates are quoted in USD and/or IDR and are inclusive of tax and services.
- Rates are not inclusive of gratuities.
- By making a booking you are confirming that you are authorized to do so on behalf of all persons named in the booking. You are acknowledging that all members of your party agree to be bound by these terms and conditions.
- We understand that each diver has their own preferences when it comes to dive sites, but please note that due to the nature of the sport, weather, availability, and scheduling may affect which dive sites can be visited. We do our best to accommodate all requests.
Cancellation and Refund
- Please let us know if you need to cancel your booking as soon as possible.
- For groups of 5 or more, cancellations made at least 48 hours in advance of the day of booking will result in your deposit being refunded in full (minus bank transfer fees).
- Cancellations for groups of 5 or more made within 48 hours of the booking will not have their deposit refunded but can be rescheduled to dive again within one calendar year.
- In the event that we cancel your booking due to weather or other unforeseen circumstances, we will provide a full refund.
- Refusal to sign the waiver of liability will result in a cancellation of your booking.
Health and Safety
- Before participating in any diving course, you must complete a medical questionnaire and disclose any relevant medical conditions.
- We reserve the right to refuse service to anyone who we believe may be at risk of injury or harm.
- You must follow all instructions provided by our dive masters and instructors.
- You must not consume alcohol or drugs before or during any diving activity.
- Fresh Fins Diving strongly recommends that guests obtain appropriate travel, medical, and diving insurance. We recommend Dive Assure for your short-term diving insurance needs and we are happy to assist you with your registration should you need it.
Liability, Loss, or Damages
- We are not liable for any loss, damage, injury or death resulting from your participation in any diving activity.
- You agree to indemnify and hold us harmless from any claims, damages or expenses arising from your participation in any diving activity.
- We are not liable for any loss, damage, or theft of personal belongings.
- The guest is responsible for returning all rented equipment in good condition. The guest further undertakes to pay for any loss and/or damage to the equipment provided to them.
Governing Law and Jurisdiction
- These terms and conditions are governed by and construed in accordance with the laws of the Republic of Indonesia.
- Any disputes arising from these terms and conditions will be subject to the exclusive jurisdiction of the courts of the Republic of Indonesia.
